1Will renovating my property increase it's value?
It is very common for us to wonder how much will our property be worth on the market if I completely renovate it.
The renovation of a property increases it’s value, only if, the renovation has been planned and studied previously by professionals. Experts in property development can confirm that renovating a property in Spain could increase the price up to 65%, but this does depend on the characteristics and features of the property.
2Which permits and licences should I apply for when renovating my property?
The municipal ordinance for the licensing of each locality establishes those actions or interventions in the building that are subject to a license.
For example, the authorisation by the City of Alicante is more or less rigorous depending on the type of work and level of protection of the building.
3Is it necessary to receive authorisation from the community to start the work?
The Horizontal Property Law says that it is the owner's obligation to inform the president of the community about the execution of work. In this way, the community makes sure that common elements are not altered (for example, throwing a load wall or a beam). However, work that does not alter the security, structure or exterior configuration of the building does not require authorisation from the community, only its knowledge.
4If the renovation of the property affects common elements (for example, a load wall, a beam etc), What is the deadline for the community to make a claim?
The property owners in the community have a period of 15 years claim period, from when the non-consensual work started. The period of time in which the community can adopt an agreement, by a simple majority, to initiate legal proceedings, requiring the infringing landlord to replace the common elements in the same conditions that existed or claim compensation for damages.
5Is there a specific timetable to undertake a renovation?
The permitted noise levels are regulated in the ordinances of protection of the urban environment of the municipality where the estate is located. In the city of Madrid, the Ordinance for the Protection of the Atmosphere against Pollution by Forms of Energy is in force, which prohibits works inside the property from 9 pm to 8 am on weekdays and from 9 pm to 9.30 on Saturdays, Sundays and public holidays. Also, the community of owners can approve by a majority agreement a rule of internal regime that regulates the periods and hours in which the owners can execute certain work (for example, renovation or installation of heating). However, this regulation can not introduce arbitrary criteria, that is, it has to be motivated or justified and supposed improvements with respect to the hours set forth in municipal regulations. In this case, the rules of internal regime would prevail.
